Terms of Service
These terms are an agreement between you and SplitCheck Pty Ltd (ACN 702 103 142, ABN 73 702 103 142), the Australian company that makes SplitCheck. In these terms, "we", "us" and "our" mean that company. "SplitCheck" or "the app" means the SplitCheck app for iPhone, the servers behind it, the answers and reports it produces, and the website at splitcheck.com.au. These terms are also the end user licence agreement for the app on the App Store. Section 14 sets out the terms Apple requires. By installing or using SplitCheck you agree to these terms. If you do not agree, please do not use SplitCheck. Effective: 27 September 2026.
The short version (a guide only; the full terms below are what apply)
SplitCheck gives an indicative answer about whether a property might be subdivided or built out. It is a starting point, not advice and not a certificate.
Always confirm with a registered town planner and the local council before you spend money or make a decision.
Your first check needs no account. After that you sign in, and the free checks shown in the app come with your account each month. Paid plans and single checks are bought through Apple. Subscriptions renew automatically unless you cancel in your Apple Account settings at least 24 hours before the current period ends.
Every answer you run is saved to your history and is free to reopen. You can delete any answer, or your whole account, in the app.
Do not scrape, resell, or bulk-query the service.
The Australian Consumer Law protects you, and nothing in these terms takes that away.
1. What SplitCheck is, and what it is not
SplitCheck takes a property address and gives you an indicative view of whether the land might be subdivided (split into two or more lots) or developed with more dwellings, and roughly how many lots, or how many dwellings, the general planning rules might allow. We calculate this from published government planning and land data. Coverage is limited to the states shown in the app (New South Wales at launch), and may change.
SplitCheck is not:
- a planning certificate (a formal council document about a property's planning controls, such as a NSW section 10.7 certificate);
- a survey, a valuation, a title search, or a development approval;
- a guarantee that any subdivision or development is permitted, or will be approved by a council or any other authority;
- legal, planning, financial, surveying, engineering, or investment advice. We are not town planners, lawyers, surveyors, or licensed advisers, and no answer creates an adviser relationship between us.
The data we rely on can be incomplete, out of date, or wrong, and the planning rules have exceptions we cannot see. A council's own controls, site conditions, easements, heritage listings, flooding, bushfire, and many other things can change the real answer. Every answer shows the assumptions it made and the things it did not account for. Please read them.
Always confirm with a registered town planner and the relevant council before you rely on anything SplitCheck tells you.
2. Do not rely on results for decisions
You use SplitCheck at your own risk. You must not make, or decide against, a purchase, sale, offer, bid, loan, development, or any other financial decision on the basis of a SplitCheck answer alone.
Every answer carries a notice that it is indicative only, is not a planning certificate, and should be confirmed with a registered town planner. That notice travels with every answer, including every PDF report and anything you share, and forms part of these terms.
A stored answer shows the date it was checked. Planning rules and data change often, so an older answer may no longer be right. Run a fresh check before you rely on it.
If you use SplitCheck in your work (for example as a buyers agent, real estate agent, or adviser), you remain responsible for your own advice to your clients. You must not present a SplitCheck answer to a client as advice, as a certificate, or as anything other than an indicative check that needs confirming.
3. Your first check, without an account
- You can run your first check without creating an account. From your second check, the app asks you to sign in. A signed-in account gets the number of free checks shown in the app each calendar month (Sydney time). Unused free checks do not carry over to the next month. The number may change.
- To count that check and show you your history on that device, the app creates a random anonymous identifier on your device and sends it with each request. Our Privacy Policy explains it.
- If you delete the app, the history on that device is lost to you. Our copy of anonymous history is deleted after 90 days. Sign in if you want to keep your history longer.
- You must not reset or tamper with the identifier, or use several devices or accounts, to get more free checks than the app allows.
4. Accounts and sign-in
- You sign in with Sign in with Apple or with a link we email you. Opening the link signs you in. There is no password.
- If you use Apple's Hide My Email option, the relay address Apple gives us becomes your account email. Keep that relay active in your Apple Account settings. If you turn it off, our emails, including sign-in links, will not reach you.
- If you sign in by emailed link, you must use an email address that is really yours and that you control.
- Keep your Apple Account and your inbox secure. Anyone who can use your Apple Account or read your email can sign in as you. Do not forward sign-in links to anyone. Sign-in links work once and expire after 15 minutes.
- An account is for one person. You must not share your account, unless your plan expressly says it covers more than one person.
- You are responsible for everything done through your account. Tell us straight away if you think someone else has used it.
- You must be at least 18 years old to use SplitCheck.
- When you sign in, the checks you ran on that device before signing in join your account and count as part of that month's checks.
- We may suspend or close accounts that break these terms (see section 11).
5. Your check history, kept answers, and PDF reports
- History is for everyone. Every successful check is saved to your history with a check id (a code like
chk_followed by 16 characters). Reopening a stored answer is free, does not count as a check, and never recalculates. It shows the answer exactly as it was on the date it was checked. - A fresh check counts. Running the same address again is a new check and counts against your free checks or plan.
- Delete any time. You can delete any stored answer in the app. Deleting an answer does not change the number of checks you have used this month.
- How long we keep it. Answers on an account are kept for 24 months from the check. Anonymous answers are kept for 90 days. Kept answers (below) are never deleted automatically.
- Keep. Plans that include "Keep" let you mark an answer as kept, so it stays until you remove it or delete your account.
- PDF reports. Plans that include reports let you generate a PDF report of a stored answer. A PDF report for a new address is a check and counts like one.
- When your plan ends. Answers you already kept stay kept. You cannot keep new answers or generate new PDF reports until you are on a plan that includes them.
- The check id is printed on every PDF report so that a report, a kept answer, and a problem report all point to the same record.
6. Free checks, plans, and single checks
- Free use. Your first check is free without an account (section 3). Once you have signed in, you can run the number of free checks shown in the app each calendar month at no charge.
- Subscriptions. Paid plans are subscriptions billed monthly or yearly through Apple. A yearly plan is billed once a year. What each plan includes, and its price, is shown in the app before you buy. Plans include a set number of checks per month, or unlimited checks under our fair use rules (section 10). Unused checks do not carry over.
- Single checks. You can buy one check at a time. A single check does not renew and does not start a subscription. It is used only after your free checks for the month are used up, and it does not expire. The answer from a paid single check is kept automatically (section 5).
- Free trials. If we offer a free trial of a plan, the app shows how long it lasts and the price that applies afterwards before you start. If you cancel at least 24 hours before the trial ends, you are not charged. If you do not cancel, the subscription starts and renews as described in section 7. Any unused part of a free trial is forfeited when you buy a subscription.
- Payment. All purchases are made through Apple's In-App Purchase system. Apple is the merchant: the charge goes to your Apple Account, Apple issues your receipt, and Apple's own terms (the Apple Media Services Terms and Conditions) also apply to the purchase. We never see your card or bank details.
- Buying with or without an account. You can buy without signing in. Signing in links your purchases to your SplitCheck account so that your plan and history travel with you. If you reinstall the app or change phones, use Restore Purchases in the app, and sign in to recover your history.
- Prices. Prices are shown in the app and the App Store in Australian dollars and include GST.
- The website sells nothing. If we ever offer purchases on the website, we will update these terms first.
7. Subscription terms that Apple requires us to state
- Payment is charged to your Apple Account when you confirm the purchase.
- A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
- Your Apple Account is charged for the renewal within the 24 hours before the current period ends, at the price shown when you subscribed (or a changed price that you have been told about, see section 8).
- You can manage or cancel your subscription at any time on your iPhone in Settings > Apple Account > Subscriptions.
- Any unused part of a free trial is forfeited when you buy a subscription.
- Refunds are requested from Apple, not from us, at reportaproblem.apple.com. Apple decides them under its own policy.
8. Cancelling, refunds, and changing plans
- Cancel any time. Cancel in Settings > Apple Account > Subscriptions. Cancelling takes effect at the end of your current billing period. You keep access until then, and you will not be charged again. Deleting the app, or deleting your SplitCheck account, does not cancel a subscription. Cancel it first.
- Refunds. Because Apple is the merchant, we cannot refund App Store purchases ourselves. Cancelling does not refund the current billing period. Apple considers refund requests at reportaproblem.apple.com under its own policy. Nothing in this section limits your rights under the Australian Consumer Law (section 13). If the Australian Consumer Law entitles you to a remedy and Apple has not provided it, contact us and we will provide the remedy the law requires: depending on the problem, a refund we arrange through Apple or pay ourselves, a repeat of the service, or extended access.
- After a plan ends you return to free use. Keep and PDF reports are no longer available (see section 5).
- Changing plans. You can switch between plans in the app or in your Apple Account settings. Apple applies the change and works out any adjustment under its own rules, and shows you what will happen before you confirm.
- Price changes. If we change the price of a subscription you hold, Apple will tell you before it applies. For some increases Apple asks you to agree to the new price first; if you do not agree, the subscription ends at the end of the current period. We will also email account holders at least 30 days before a price rise takes effect.
9. Changes to the service and these terms
- The service. We may add, change, or remove features, coverage, or plans. We may pause the service for maintenance or for security reasons, and we will try to give notice of planned maintenance.
- Discontinuing. If we stop offering SplitCheck, we will give paid subscribers at least 30 days notice and refund any unused part of a period you have already paid for, through Apple where possible or directly from us.
- These terms. We may update these terms. We will post the new version here with a new effective date, and we will tell account holders about significant changes, by email or in the app, at least 14 days before they apply. If you keep using SplitCheck after that, you accept the updated terms. If you do not agree, stop using the app and cancel any subscription. A change that reduces what a paid plan includes applies to you only from your next renewal, so you can cancel before it affects anything you have already paid for.
10. Fair use and acceptable use
You must not:
- scrape, crawl, or copy the service or its answers in bulk by any automated means, or access our servers other than through the app as we provide it;
- run automated or bulk queries, or use the service to build your own database of answers;
- resell the service or its answers, or bundle answers into a product or paid report of your own;
- get around our limits, for example by resetting your anonymous identifier, creating more than one account, sharing an account, or interfering with our usage meter, rate limits, or security measures;
- overload, disrupt, or probe the service, or the government data services behind it;
- reverse-engineer, modify, or redistribute the app, except where the law allows;
- use the service for anything unlawful, or to harass or harm anyone.
What you can do. You may share an individual answer or PDF report with a client or colleague, and you may refer to an answer in your own work, as long as you make clear that it is indicative and comes from SplitCheck.
Unlimited plans. "Unlimited" means unlimited normal use by a person, or by a team where the plan covers one. If your use goes far beyond what a person or team would do by hand (for example, thousands of checks a day), we may contact you, slow your access, or ask you to move to a plan that suits your use.
We use rate limits and other protections. They may briefly block unusually heavy use.
11. Suspending or ending your account
- We may suspend or close your account if you break these terms, or if we must for legal or security reasons. For serious breaches we may act immediately. Otherwise we will warn you first where that is reasonable.
- You can delete your account in the app at any time. Deleting your account does not cancel a subscription bought through Apple; cancel it first (section 8). Our Privacy Policy explains what deletion removes.
- Sections that by their nature should continue after your account ends (including sections 2, 12, 13, 14, and 16) continue to apply.
12. Intellectual property and your licence
- Ours. The SplitCheck app, software, design, text, name, and logo belong to us or to our licensors. We give you a personal, non-transferable, revocable licence to install and use the app on Apple-branded devices that you own or control, as the App Store usage rules permit, and to use the service under these terms. You do not get any other rights.
- Government data. Answers are built from planning and land data published by Australian state governments, used under their open licences (for example, Creative Commons Attribution). The attribution is shown with each answer. Aerial imagery shown with an answer is NSW Government imagery (Department of Customer Service, NSW Spatial Services, licensed under Creative Commons Attribution); its credit appears on the map and in the answer's list of sources. Keep it if you share an answer.
- Google Maps. Address search and matching use Google Maps Platform. When you use that feature you also agree to the Google Maps/Google Earth Additional Terms of Service (maps.google.com/help/terms_maps) and Google's Privacy Policy (policies.google.com/privacy) as they apply to it.
- Yours. The addresses and other information you enter are yours. You give us permission to use them to run the service for you, as described in our Privacy Policy.
- Your answers. You may view, save, print, and share individual answers and PDF reports for your own purposes, subject to section 10.
- Feedback. If you send us suggestions, feedback, or problem reports, we may use them to improve SplitCheck without owing you anything.
13. Australian Consumer Law and our liability
Your consumer guarantees are not excluded. If you are a consumer under the Australian Consumer Law, the app and our services come with guarantees that cannot be excluded, including that they are of acceptable quality and are provided with due care and skill. Nothing in these terms excludes, restricts, or changes any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Apple's refund process (section 8) does not replace those rights.
Where the law lets us limit liability for services. Where the Australian Consumer Law allows it (section 64A: where the service is not of a kind ordinarily bought for personal, domestic, or household use, and it is fair and reasonable to do so), our liability for failing to meet a consumer guarantee is limited, at our choice, to supplying the service again or paying the cost of having it supplied again. We do not rely on that limitation against anyone who uses SplitCheck for personal, domestic or household purposes.
Beyond those guarantees, to the fullest extent the law allows:
- SplitCheck is provided "as is" and "as available". We do not promise that answers will be accurate, complete, current, or fit for any particular purpose, or that the service will be available without interruption.
- We are not liable for any loss that comes from relying on an answer, or from any decision you make (or do not make) because of an answer, including a decision to buy, sell, bid, make an offer, borrow, or develop.
- We are not liable for indirect or consequential loss (loss that follows on from an event, such as lost profit on a deal), loss of profit, loss of opportunity, or loss of data.
- We are not liable for errors in the government data we rely on. We do not control that data, and errors in it flow through to answers.
- Our total liability to you for all claims connected with SplitCheck in any 12-month period is limited to the amount you paid for SplitCheck through the App Store in that period, or AUD $100, whichever is more.
Nothing in this section limits any liability that the law does not allow us to limit.
14. Terms that Apple requires (App Store)
Because the app is distributed through Apple's App Store, Apple requires the following terms. They apply to the app itself.
- Acknowledgement. These terms are an agreement between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content. The Apple Media Services Terms and Conditions also apply to your use of the app, and these terms do not give you fewer rights than those.
- Scope of licence. Your licence to the app is a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing, where those features apply. (SplitCheck plans are not enabled for Family Sharing.)
- Maintenance and support. We, not Apple, are responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support for it.
- Warranty. We are responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- Our name and address. Our contact details are in section 17. Send any questions, complaints, or claims about the app to us there.
- Third-party terms. You must comply with any third-party terms that apply when you use the app, for example your mobile data agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
15. Privacy
Our Privacy Policy explains what information we collect and how we handle it. It forms part of these terms.
16. General
- Governing law. These terms are governed by the laws of South Australia, Australia. You and we agree to the non-exclusive jurisdiction of the courts of South Australia. This does not stop you bringing a claim in a court or tribunal in your own state where the law gives you that right.
- Whole agreement. These terms, and the Privacy Policy, are the whole agreement between you and us about SplitCheck.
- If part is invalid. If any part of these terms cannot be enforced, the rest still applies.
- Transfer. We may transfer this agreement to a related company, or to a buyer of the SplitCheck business, and we will tell you if we do. You may not transfer your account to anyone else.
- Notices. We will send notices to the email address on your account, or show them in the app. Send notices to us at the addresses in section 17.
- No waiver. If we do not act on a breach of these terms straight away, we can still act on it later.
- Complaints. If you have a problem with SplitCheck, contact us first and we will try to fix it.
